How many affected vehicles were sold or leased in Canada?

Approximately 105,000 affected vehicles were sold or leased in the Canadian market when the emissions accusations became public on September 18, 2015.

What are the options available to the affected consumers?

If approved by the courts, the 2.0L TDI settlement program will include restitution payments to eligible owners and lessees.

Many of these eligible settlement class members will also have options that may include:

  1. Selling their vehicle to Volkswagen (the buyback option) based on the vehicle’s Canadian Black Book® Inc. wholesale value as of September 18, 2015, with adjustments for factory options, region of registration and mileage at the time of the buyback offer;
  2. Trading in their vehicle and applying its fair market value at the time of the trade-in towards the purchase of a new or used Volkswagen or Audi vehicle. In addition, eligible settlement class members who choose the trade‑in option will receive payment of any amount by which their vehicle’s wholesale value as of September 18, 2015 exceeds its fair market value at the time of the trade‑in;
  3. Early lease termination without any early termination penalty; and
  4. Keeping their vehicle and receiving an emissions modification, if approved by regulators, plus an extended emissions warranty.

As with any class action settlement agreement, settlement class members are able to opt out of this settlement.

How much can consumers expect to get in restitution?

Under the proposed 2.0L TDI settlement program, all eligible settlement class members qualify for a restitution payment. The payment amount will depend on the model year and make of the eligible vehicle. The amount will also depend on a consumer’s settlement class member category. Eligible settlement class members are divided into four categories based on whether they are owners or lessees of their eligible vehicle and, if they are owners, when they owned.

When can consumers expect to receive benefits? When can consumers claim the restitution payments?

The proposed nationwide class settlement needs to be approved by the courts in Ontario and Quebec. The courts’ approval hearings will take place likely in March 2017. If the settlement is approved, eligible settlement class members who wish to make a claim for benefits will be provided with instructions for when and how to submit a claim.
